Welcome to ChatRod! These Terms and Conditions (“Terms”) govern your use of ChatRod (the “App”), which is owned and operated by Joshua’s Girdle (“we”, “us”, “our”). By accessing or using the App, you agree to these Terms. If you do not agree, please do not use the App.
By downloading, accessing, or using ChatRod, you confirm that you have read, understood, and agree to these Terms. If you are under 18 years of age, you must have your parent or guardian’s consent to use the App.
Please note: Your continued use of the App constitutes acceptance of these Terms and an understanding that Joshua’s Girdle is not liable for any misuse or violations of the law by users or third parties.
We reserve the right to modify these Terms at any time. Any changes will take effect immediately upon posting. Your continued use of the App following any modifications indicates your acceptance of the updated Terms. You agree that it is your responsibility to review these Terms periodically.
3.1 Account Registration
To access certain features of the App, you may be required to create an account. You agree to provide accurate and up-to-date information. You are responsible for maintaining the confidentiality of your account information and any activities that occur under your account.
3.2 Account Responsibility
Joshua’s Girdle is not responsible for any unauthorized access to or use of your account. If you become aware of any unauthorized use of your account, you must notify us immediately using the contact options provided within the App.
4.1 Ownership of Content
While you retain ownership of the content you create and post on ChatRod, by posting content, you grant Joshua’s Girdle a non-exclusive, worldwide, royalty-free, and perpetual license to use, reproduce, modify, distribute, and display your content in connection with the App and related services.
4.2 Prohibited Content
You agree not to post any content that:
Violates any local, national, or international laws.
Contains hate speech, harassment, threats, or promotes violence or illegal activities.
Infringes upon the intellectual property or privacy rights of others.
May cause harm, offense, or injury to individuals or entities.
Joshua’s Girdle reserves the right, at its sole discretion, to remove any content that violates these Terms or is deemed inappropriate, but is under no obligation to monitor user content.
4.3 Content Liability
You agree that you are solely responsible for the content you post on the App. Joshua’s Girdle assumes no responsibility for content posted by users and is not liable for any legal claims, damages, or losses resulting from user content or misuse of the App.
You agree to follow our community guidelines to maintain a safe and respectful environment for all users. Violation of these guidelines may result in suspension or termination of your account.
Joshua’s Girdle disclaims all liability for actions taken by users, including violations of the community guidelines, misuse of the platform, or illegal activities carried out via the App.
6.1 Ownership
All intellectual property related to ChatRod, including the software, logos, trademarks, and design, is owned by Joshua’s Girdle or its licensors. You are granted a limited, non-exclusive license to use the App for personal, non-commercial purposes.
6.2 Infringement Claims
If you believe your intellectual property rights have been violated, you may contact us using the links provided within the App. Joshua’s Girdle will investigate claims and take necessary action where appropriate.
By using the App, you consent to the collection and use of your personal information as outlined in our Privacy Policy, available within the App. We take privacy seriously, but Joshua’s Girdle is not liable for any data breaches or unauthorized access to your information caused by third-party actions or failures in data protection.
8.1 Coins
ChatRod uses a virtual currency system where users can purchase “Coins” to promote content or support other creators. Coins are non-refundable, have no cash value, and are not transferable.
8.2 Usage of Coins
In addition to promoting content, Coins can be used to gift creators during LIVE sessions. Joshua’s Girdle is not responsible for any misuse of Coins or dissatisfaction with how they are spent within the App.
You may encounter advertisements from third-party providers within ChatRod. Joshua’s Girdle is not responsible for any interactions, transactions, or agreements between you and third-party advertisers. All dealings are solely between you and the advertiser.
10.1 General
To the fullest extent permitted by law, Joshua’s Girdle, its affiliates, directors, employees, and agents are not liable for any damages, losses, or claims arising from your use of ChatRod. The App is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied.
10.2 App Misuse
Joshua’s Girdle is not liable for any actions of users that result in harm, legal issues, or violations of law. Misuse of the App is the sole responsibility of the user.
10.3 Third-Party Liability
Joshua’s Girdle is not responsible for content or services provided by third parties, including advertisers, partners, or other users, nor liable for any damages or legal consequences arising from third-party interactions.
You agree to indemnify and hold harmless Joshua’s Girdle from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the App, your content, or any breach of these Terms.
12.1 Termination by You
You may delete your account at any time. Upon account deletion, your content may no longer be accessible, but Joshua’s Girdle may retain certain information as required by law or for legitimate business purposes.
12.2 Termination by Us
Joshua’s Girdle reserves the right to suspend or terminate your access to the App at its discretion if you violate these Terms, engage in illegal activities, or misuse the platform.
These Terms are governed by the laws of the jurisdiction in which you are using the App. You agree that any disputes arising out of or relating to these Terms will be subject to the exclusive jurisdiction of the courts in that country or region.
In the event of a dispute, you agree to first contact us via the in-app communication tools. We will endeavor to resolve any issue in good faith. If we cannot resolve the dispute informally, you agree that all disputes will be handled through binding arbitration, unless prohibited by law
These Terms and any disputes arising from your use of ChatRod will be governed by the laws of any country or region where the App is being used, except where local laws prohibit such governance.
